4 <br /> <br />Staff Comments: These items have been addressed. <br /> <br />1. An additional 7ft of street right-of-way along 24th Avenue is required for future turn <br />lanes. <br />2. A shared driveway agreement and exhibit shall be drafted by the developer. <br />a. The agreement shall detail private maintenance responsibilities of the driveway, <br />landscaped parking lot median, island landscaping, lighting etc. This will be <br />required prior to issuing a building permit for the commercial daycare. <br />3. A 5ft wide sidewalk shall be installed along both the north and south side of Rosemary <br />Way and terminate at the end of the street construction. <br /> <br />Easements <br /> <br />Standard drainage and utility easements at least 10 feet wide have been provided over the lots <br />lines. An oversized 20 ft wide drainage & utility easement is provided along the east lot line of <br />Lot 1 for drainage. <br /> <br />Public Land Dedication <br /> <br />The City will collect the following cash fee in lieu of land dedication for commercial <br />development for final platted Lot 1, Belland Farms Second Addition. <br /> <br />Belland Farms Second Addition <br />1.52 acres x $2,520 per acre = $3,830.40 <br /> <br />Site and Building Plan Review <br /> <br />As noted, New Horizon Academy will be constructed on Lot 1, Block 1. The September 12, <br />2022 City Council staff report and resolutions detail the site and building plan review and <br />conditional use permit for the daycare. Development of future lots will require full site and <br />building plan review. <br /> <br />Signage <br /> <br />A monument sign is shown on the southeast corner of Lot 1. A separate Sign Permit <br />Application with detailed sign information is required for any on site or building signage. <br /> <br />Agreements <br /> <br />Stormwater Maintenance Agreement <br /> <br />The stormwater facilities (Pond 100P and outlet pipes to the wetland) on Outlot A will be <br />privately maintained and a Declaration for Maintenance of Stormwater Facilities will be <br />required. New Horizon Academy will have a separate declaration for onsite facilities. <br /> <br />Development Agreement and Final Plat <br />
