1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6F <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> <br />MEETING DATE: October 24, 2022 <br /> <br />TOPIC: Consider 2nd Reading of Ordinance No. 04-22 Marketplace PDO <br />Amendment #3 related to 601 Apollo Retail <br /> <br />*Council may vote to dispense with full reading of ordinance <br />* Roll call vote is required for adoption of the ordinance <br /> <br /> <br />VOTE REQUIRED: Simple Majority <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the 2nd reading of Ordinance No. 04-22 <br />amending Marketplace Planned Development Overlay (PDO) Design Guidelines Ordinance <br />No. 03-05. The 1st Reading was approved by the City Council on October 10, 2022. <br />BACKGROUND <br />The applicant, Java Lino Retail, LLC, submitted a Land Use Application for two (2) separate <br />commercial buildings (a 4,200 sf dental clinic and a 2,240 sf coffee shop) and a drive thru <br />ATM on one (1) lot located at 601 Apollo Drive. Per the Marketplace Planned Development <br />Overlay (PDO) Design Guidelines Ordinance No. 03-05 and site plan, this lot is to be <br />developed as a bank. An amendment to the ordinance is required to change the site use from a <br />bank to the proposed uses. <br /> <br />ANALYSIS <br />The October 10, 2022 Council staff report details the project. The Planning & Zoning Board <br />held a public hearing on September 14, 2022 and recommended approval with a 5-0 vote. The <br />City Council passed Resolution No. 22-115 that details the findings of fact. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 2 <br />nd Reading of Ordinance No. 04-22. <br /> <br />ATTACHMENTS <br /> <br />1.
