3 <br /> <br />Chapter 12 of the 2040 Comprehensive Plan includes the following implementation strategies: <br /> <br />1. “Review and update the zoning map as needed to eliminate any inconsistencies with <br />the Comprehensive Plan. <br /> <br />3. Consider creating new zoning districts: <br />a. As “holding zones” for urban development. Holding zones would provide a <br />zoning classification appropriate to land planned for future urban development <br />but where municipal services are not yet available. The holding zone would apply <br />until a landowner/ developer makes application for development, at which time <br />the city may rezone the property consistent with its designation on the future land <br />use plan map, provided that the development does not result in the premature <br />extension of public utilities, facilities or services.” <br /> <br />The zoning map has been revised to be consistent with the future land use of the 2040 <br />Comprehensive Plan, creates a holding zone for urban development and corrects existing errors <br />in the zoning map. There are 1,965 parcels that will be rezoned as part of this effort; however, <br />the number of substantive changes is far fewer. The zoning map changes fall into four main <br />categories: <br /> <br />1. Planned Unit Development (PUD) District. The City changed Planned Development <br />Overlay (PDO) to Planned Unit Development (PUD) with the zoning ordinance update in <br />2003. The City is rezoning all properties previously shown as a PDO to a PUD to reflect <br />that change. This change represents 1,225 of the 1,965 properties proposed to be changed <br />with the zoning map updates. Other than the name of the zoning district there is no <br />regulatory change to these parcels. <br /> <br />2. Future Urban Development (FUD) District. The FUD zoning map changes reflect a <br />change planned as part of the 2040 Comprehensive Plan implementation. The change <br />applies to parcels, currently zoned R-Rural, that are located within the planned 2040 <br />Utility Staging Area. The only change from R to FUD is that the FUD zone has a higher <br />minimum lot size of 20 acres to preserve the land for development. The permitted, <br />conditional and accessory uses allowed in the FUD zone will remain the same as the <br />Rural (R) zone. The zoning change will not result in any currently allowed uses to <br />become nonconforming. This change to the zoning map represents 640 of the 1,965 <br />properties proposed to be changed with the zoning map updates. <br /> <br />3. Land Use Consistency. There are a number of parcels which have been rezoned to be <br />consistent with the 2040 future land use for the property. State law required zoning to be <br />brought into compliance with the adopted land use designation. This represents 60 of <br />1,965 properties being rezoned. If an existing legally established use is inconsistent with <br />the new zoning, the use will become legal non-conforming and may continue, as legally <br />established, until such time as the use ceases or the property is redeveloped. <br />
