EDA Member Cavegn seconded the motion. 16 <br />Motion carried on a voice vote. 17 <br /> 18 <br />ACTION ITEM 19 <br /> 20 <br />A) Public Hearing. Consideration of Resolution No. 22-01 Approving Purchase 21 <br />and Development Agreement with Silver Creek Equity, LLC. , Lots 1-3, Outlot B & 22 <br />C, The Village No. 4 23 <br /> 24 <br />Community Development Director Grochala reviewed the written staff report: 25 <br />- History of Legacy at Woods Edge land, including land sales; 26 <br />- Land use Plan for Legacy at Woods Edge; 27 <br />- Silver Creek Equity is proposing purchase (site noted on map); 28 <br />- Proposing to construction housing, retail and restaurants, generally consistent with 29 <br />the land use plan; 30 <br />- Purchase price noted; earnest payments required; 31 <br />- Closing date proposed; 32 <br />- Development requirements reviewed; 33 <br />- Signage; 34 <br />- Project is generally consistent but approval process ahead. 35 <br /> 36 <br />EDA Member Rafferty asked about who the developers plan to use for architecture – 37 <br />Tushie Montgomery was noted. 38 <br /> 39 <br />EDA President Ruhland asked staff about the terms of the earnest money refund and Mr. 40 <br />Grochala noted the time period (120 days). EDA President Ruhland noted that the 41 <br />commercial element is required concurrent with the housing and he wonders how that 42 <br />will be enforced. Mr. Grochala suggested that the building permit process will provide 43 <br />some oversight. Mr. Grochala noted that the restaurant element takes less time to build 44
