1st Reading: Publication: <br />2nd Reading: Effective: <br /> <br />CITY OF LINO LAKES <br />ORDINANCE NO. 09-22 <br /> <br />ORDINANCE AMENDING CHAPTER 507, SECTION 507.06, OF CITY CODE <br />RELATING TO SOLID WASTE STORAGE <br /> <br />The City Council of Lino Lakes ordains: <br />Section 1. That Section 507.06 of the Lino Lakes Code of Ordinances be amended to <br />read as follows: <br /> <br />§ 507.06 SOLID WASTE STORAGE. <br />The owner, occupant and/or the person in control of any residential property, business <br />establishment or industry, shall be responsible for the satisfactory storage of all mixed municipal <br />solid waste accumulated at the premises, business establishment or industry. <br />(1) Garbage shall be stored in durable, rust-resistant, non-absorbent, watertight, rodent- <br />proof and easily cleanable containers, with close-fitting, fly-tight covers and/or disposable plastic <br />bags with tightly sealed openings. Refuse shall be stored in durable containers. Where garbage is <br />stored in combination with refuse, containers for the storage of the mixture shall meet the <br />requirements for garbage containers. <br />(2) All containers for the storage of garbage and refuse shall be maintained in a manner <br />as to prevent the creation of a nuisance or menace to public health. Containers that are broken or <br />otherwise fail to meet requirements of this chapter shall be replaced with acceptable containers. <br />(3) Every property owner, occupant, or owner of any dwelling unit or place of business <br />shall control the refuse on the premises so as to keep the premises in a clean and sanitary <br />condition. All refuse accumulating between the times of collection shall be placed in containers. <br />Containers shall not be left at the curbside for more than 24 hours. <br />(4) Container placement for collection <br />(a) Dwelling units, except apartment buildings and manufactured homes not <br />contracting for curbside service: On the designated pickup day, refuse, recyclables and <br />yard waste shall be set out for collection immediately behind and within two feet of the curb. <br />Containers shall not be placed in the street. <br />(b) Businesses: Every property owner, occupant or owner of a place of business shall <br />place containers used for the storage of refuse, recyclables and yard waste in conformance <br />with the city zoning ordinances. Such containers shall be accessible to the haulers at all <br />reasonable times. <br /> <br />Section 2. Effective Date. This Ordinance shall be effective from and after its passage <br />and publication according to the Lino Lakes City Charter. <br /> <br />Adopted by the Lino Lakes City Council this ____ day of ________________ 2022. <br /> <br />The motion for the adoption of the foregoing ordinance was introduced by Councilmember <br />_____________and was duly seconded by Councilmember ___________ and upon vote being <br />taken thereon, the following voted in favor thereof: <br />The following voted against same:
