7

(f) The proposed development shall be served with an adequate or safe sanitary
sewer system.

The proposed earth moving and stockpiling does not require service by sanitary
sewer. Municipal sanitary sewer is located along is located along Phelps Road and can
be extended to the property should the applicant wish to connect in the future.

(g) The proposed development shall not result in the premature expenditures of
City funds on capital improvements necessary to accommodate the proposed development.

The proposed earth moving and stockpiling operation will not expend City funds.

(h) Fire prevention and fighting equipment acceptable to the Board of Fire
Underwriters and City Council shall be readily available when any activity involving the
handling or storage of flammable or explosive materials is carried on.

The proposed earth moving and stockpiling operation does not involve any activity
handling or storing flammable or explosive materials.

In addition to the criteria established under Section 1007.017, Interim Use Permits,
Section 1007.051(4), Earth Moving and Land Reclamation establishes the following
conditions that shall be met:

(a) Properly fence any pit or excavation, and barricade entrances to prevent
the general public from depositing garbage or refuse.

The proposed plans indicate earth moving for stockpiling, not a pit. The proposed plans
do not currently show any fencing around the earth moving areas or any barricades at
the entrance, other than silt fence.

(b) Slope the banks, and otherwise guard and keep any pit or excavation in
such condition as not to be dangerous because of sliding or caving banks.

The fill stockpiles are proposed with 4:1 side slopes on all sides, reducing the risk of
sliding or caving banks. Areas not being worked shall be established with turf within
seven (7) days of placement to avoid sliding.

(c) Properly drain, fill, or level off any pit or excavation so as to make the
same safe and healthful as the City may determine.

The proposed earth moving and stockpiling site is designed to drain in a similar manner
as the existing conditions. The majority of the site will drain towards the existing
wetlands and Clearwater Creek. Erosion control is proposed and will be needed to
ensure that sediment is prevented from entering the wetlands and Clearwater Creek.
