8 <br />Findings of Fact-Final Plat <br />The Planning and Zoning Board shall consider the final plat and the Community <br />Development Department shall forward the Planning and Zoning Board <br />recommendations to the City Council. The following requirements shall be met before <br />consideration of the final plat by the Planning and Zoning Board: <br />1. The final plat shall substantially conform to the approved preliminary plat and <br />phasing plan. <br />The final plat substantially conforms with the preliminary plat. <br />2. For plats that consist solely of individual single family residential lots, final plat <br />applications for subsequent phases shall not be approved until building permits <br />have been issued for 40% of lots in the preceding phase. This division applies <br />only when the preceding phase consists of 40 or more lots; and <br />Not applicable. There is only one (1) phase of development proposed with the single <br />family house. <br />3. Conditions attached to approval of the preliminary plat shall be substantially <br />fulfilled or secured by the development agreement, as appropriate. <br />Securities will be required with a Development Agreement. <br />RECOMMENDATION <br />Staff recommends approval of the Bluebill Ponds 2nd Addition final plat with the <br />following conditions being addressed prior to release and recording of the final plat: <br />1. As shown on Sheet S1, Boundary Survey/Preliminary Plat prepared by Kurth <br />Surveying, Inc. revision date May 5, 2023, the following encroachments shall be <br />corrected: <br />a.The shed encroaching onto the subject site shall be relocated onto 566 <br />Main Street property. <br />i.A Zoning Permit is required. <br />b.The deck/stairs concrete pad shall either be relocated or an Encroachment <br />Agreement shall be drafted by the applicant and recorded against the <br />property. <br />i.If the concrete pad is proposed to be relocated, the owner shall <br />submit a building permit and construction plan prepared by a <br />licensed architect. <br />2. PID# 08-31-22-21-0002 shall be deeded to PID# 08-31-22-21-0006 (566 Main <br />Street-Bethel Moldovian Baptist Church) and combined into one (1) parcel. <br />3.A Development Agreement shall be executed. <br />4. A WCA Notice of Decision shall be issued by RCWD.
