12 <br /> <br />a. A fence for a sport court not exceeding 12 feet in height may be located at <br />least 10 foot from side and rear lot lines. <br /> <br />b. Residential and rural boundary line fences not exceeding eight (8) feet in <br />height may be located along a lot line abutting a commercial, industrial, or <br />semi-public use or zoning district. <br /> <br />I-35W and I-35E Setbacks <br /> <br />The current zoning ordinance establishes Street Right-of-Way setbacks. On a double frontage <br />lot, the street right-of-way setback applies to both the front and rear lot lines. For example, the <br />properties 248-400 Apollo Drive are zoned LI, Light Industrial. The street right-of-way setback <br />from both CSAH 12 (Apollo Drive) and I-35W, both arterial streets, is 50 feet. In practice, a 50 <br />foot front setback has been applied along Apollo Drive and a 15-30 foot rear setback has been <br />applied along I-35W. Technically, the rear setback should be 50 feet. This would unnecessarily <br />encumber the rear yard. <br /> <br />Staff is proposing parcels abutting I-35W or I-35E that are zoned industrial have a street right- <br />of-way setback along the interstate of 15 feet which is consistent with the required rear lot line <br />setback. <br /> <br />• Proposed Amendment (This is just an example of how the LI, Light Industrial District will <br />read. The final amended ordinance will include the same changes for the GI, General <br />Industrial and BC, Business Campus Districts.) <br /> <br />Section 1007.120 LI, Light Industrial District. <br /> <br />(2) Lot and Setback Requirements. <br /> <br />(c) Setbacks. <br /> <br />1. From Street Right-of-Way. <br /> <br />a. Local or Minor Collector Street. 30 feet. <br /> <br />b. Collector or Arterial Street. 50 feet. <br /> <br />b.c. I-35W or I-35E. 15feet. <br /> <br />c.d. Parking Lot. 15 feet. <br />
