EDA Member Cavegn seconded the motion. <br />17 Motion carried on a voice vote. <br />18 <br />19 ACTION ITEM <br />20 <br />21 A) Public Hearing. Consideration of Resolution No. 22-01 Approving Purchase <br />22 and Development Agreement with Silver Creek Equity, LLC. , Lots 1-3, Outlot B & <br />23 C, The Village No. 4 <br />24 <br />25 Community Development Director Grochala reviewed the written staff report: <br />26 - History of Legacy at Woods Edge land, including land sales; <br />27 - Land use Plan for Legacy at Woods Edge; <br />28 - Silver Creek Equity is proposing purchase (site noted on map); <br />29 - Proposing to construction housing, retail and restaurants, generally consistent with <br />30 the land use plan; <br />31 - Purchase price noted; earnest payments required; <br />32 - Closing date proposed; <br />33 - Development requirements reviewed; <br />34 - Signage; <br />35 - Project is generally consistent but approval process ahead. <br />36 <br />37 EDA Member Rafferty asked about who the developers plan to use for architecture – <br />38 Tushie Montgomery was noted. <br />39 <br />40 EDA President Ruhland asked staff about the terms of the earnest money refund and Mr. <br />41 Grochala noted the time period (120 days). EDA President Ruhland noted that the <br />42 commercial element is required concurrent with the housing and he wonders how that will <br />43 be enforced. Mr. Grochala suggested that the building permit process will provide some <br />44 oversight. Mr. Grochala noted that the restaurant element takes less time to build than the <br /> 1 <br /> <br />
