CITY OF LINO LAKES <br /> RESOLUTION NO. 23-126 <br /> APPROVING LYNGBLOMSTEN PUD DEVELOPMENT STAGE PLAN AND PUD FINAL PLAN <br /> AMENDMENT#2-NORTH LOT LINE FENCE AND PICKLEBALL COURT <br /> WHEREAS, the City received an application for PUD Development Stage Plan and Final <br /> Plan Amendment#2 for Lyngblomsten hereafter referred to as Amendment#2; and <br /> WHEREAS, on April 8, 2019 the City Council passed Resolution No. 19-42 approving the <br /> PUD Development Stage Plan/Preliminary Plat; and <br /> WHEREAS, on July 26, 2021 the City Council passed Resolution No. 20-94 approving the <br /> PUD Final Plan/Final Plat; and <br /> WHEREAS, the PUD Development Stage Plan and Final plan included a fence along the <br /> north lot line and no pickleball court was included in the approved plans; and <br /> WHEREAS, Amendment#2 proposes to omit the north lot line fence and construct a <br /> pickleball court in the southwest corner of the development; and <br /> WHEREAS, Amendment#2 consists of the following documents: <br /> • PUD Amendment Application, narrative, and photos submitted by the applicant on <br /> October 16, 2023; and <br /> WHEREAS, a public hearing was held before the Planning & Zoning Board on November <br /> 8, 2023. The Board recommended with a 7-0 vote to not require fence along the north lot line <br /> with the condition that the landscape plan be revised by a professional landscape architect. The <br /> Board also recommended with a 7-0 vote to not allow construction of the pickleball court. <br /> NOW,THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: <br /> FINDINGS OF FACT <br /> Per City Code Section 1007.024: <br /> (2) The PUD, by allowing deviation from the strict provisions of this ordinance related to <br /> setbacks, heights, lot area, width and depths, yards, etc., may be considered by the City when it <br /> would result in one or more of the following public benefits: <br /> (a) Implementation of a master plan consistent with the Planning District objectives of <br /> the Comprehensive Plan. <br /> 1 <br />
