CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 6C <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> <br />MEETING DATE: January 8, 2024 <br /> <br />TOPIC: Consider Resolution No. 24-02 Determining Intent of City Code <br />Chapter 1007 Relating to Building Type and Construction-Exterior <br />Wall Finishes <br /> <br />VOTE REQUIRED: 3/5 <br />______________________________________________________________________________ <br /> <br />INTRODUCTION <br /> <br />The applicant, Taylor Miller of TS Miller Company, LLC, submitted a land use application to <br />appeal staff’s interpretation of the zoning code relating to building type and construction and <br />exterior wall finishes. The business is Rice Industries, Inc. located at 424 Apollo Drive. <br />BACKGROUND <br /> <br />History <br /> <br />Rice Industries, Inc. is proposing to build a 13,418 sf addition to include warehouse and <br />production space that will be serviced by two (2) new loading docks. As part of the expansion, <br />the business has been working with the City to acquire an adjacent parcel for additional <br />stormwater management. <br /> <br />In October 2023, the applicant submitted a Land Use Application for Site & Building Plan <br />Review. Staff’s review of the plans indicated the proposed exterior materials did not meet <br />zoning code. City staff and the applicant had several meetings to discuss the issue. The <br />applicant does not concur with staff’s interpretation and has submitted a formal Land Use <br />Application for Appeal. <br /> <br />Appeal <br /> <br />City Code Section 1007.018 Variances and Appeals provides a process for the appeal of an <br />interpretation of intent of the zoning code.
