1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6B <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: January 8, 2018 <br /> <br />TOPIC: Consider Resolution No. 18-01 Approving Utility Fee Refund, <br />Lot 1, Block 1, Chavez Preserve <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council approval of Resolution No. 18-01, Approving Utility Fee <br />Refund, Lot 1, Block 1, Chavez Preserve. <br /> <br />BACKGROUND <br /> <br />The Chavez Preserve is a six unit development that was approved by the City Council on July <br />10, 2018 via Resolution No. 17-62. As part of the development requirements, the developer is <br />to pay City Sewer Availability (SAC) and Water Availability (WAC) fees. The SAC and WAC <br />fees are then registered with Anoka County as assessments, in this case, on November 30th <br />2017 .The assessments are paid in full when the builder closes on the house and makes the <br />connection to the municipal utility system. These assessments have been paid. <br /> <br />There was an existing house on the site that was removed as part of the development. It was <br />recently brought to the City’s attention that the house was connected to municipal utilities and <br />that the SAC and WAC fees were previously paid. <br /> <br />Staff reviewed the case and confirmed that one unit of SAC and WAC fees were previously <br />paid in 2002. It is recommended that the developer be credited for one unit of SAC and WAC <br />fees. The credit due is $16,188.77. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of 1. Resolution No. 18-01 Approving Utility Fee Refund, Lot <br />1, Block 1, Chavez Preserve. <br /> <br />ATTACHMENTS <br /> <br />1.
