COUNCIL MINUTES March 12, 2018 <br />DRAFT <br />3 <br />Council Member Stoesz asked if there could be any economies by bundling the work with other cities 91 <br />and Ms. Hankee said that staff has investigated that type of joint effort but hasn’t seen the benefit to 92 <br />the City. 93 <br /> 94 <br />Council Member Rafferty moved to approve Resolution No. 18-24 as presented. Council Member 95 <br />Maher seconded the motion. Motion carried on a voice vote. 96 <br /> 97 <br />6B) Consider Resolution No. 18-26 Objecting Amendments to Water Appropriations Permit 98 <br />1985-6168 – City Engineer Hankee reviewed the written staff report outlining staff’s work to draft an 99 <br />objection to the amendment proposed to the city’s water appropriations permit. Other communities 100 <br />impacted are considering the same type of action to reserve future rights. She reviewed the elements 101 <br />that would be considered for objection. 102 <br /> 103 <br />Council Member Maher asked if other cities have appealed the actions and Ms. Hankee said yes, 104 <br />noting White Bear Township. 105 <br /> 106 <br />Community Development Director Grochala explained that staff recommends this action to keep the 107 <br />city’s options open. The city will be looking carefully at the order for any impacts or concerns and 108 <br />then decide if objections are appropriate. 109 <br /> 110 <br />Mayor Reinert explained the background that brings the city to this point. A lawsuit was brought by a 111 <br />few property owners on White Bear Lake and there is a resulting legal determination. The City has a 112 <br />small area included in the impacted area, shouldn’t be included in the ramifications. 113 <br /> 114 <br />Council Member Manthey commented that he supports this action because the information received 115 <br />about the lawsuit indicated that communities received limited information and involvement and he 116 <br />hopes this action will guarantee that the city will be heard. 117 <br /> 118 <br />Council Member Manthey moved to approve Resolution No. 18-26 as presented. Council Member 119 <br />Stoesz seconded the motion.
