1 <br /> <br />JOINT POWERS AGREEMENT <br />SANITARY SEWER AND WATERMAIN SERVICE AGREEMENT <br />IN THE CITIES OF LINO LAKES, MN AND SHOREVIEW, MN <br /> <br /> <br /> THIS AGREEMENT is made and entered into this day of , 2018 by and <br />between the City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, MN 55014, and the City of <br />Shoreview, 4600 Victoria Street North, Shoreview, MN 55126. <br /> <br />WITNESSETH <br /> <br />WHEREAS, Ash Street (CR J/CSAH 32) is a border road between the Cities of Lino Lakes and the City <br />of Shoreview. Ash Street (CR J/CSAH 32) is a County Road under the jurisdiction of Anoka County <br />and Ramsey County; and <br /> <br />WHEREAS, the City of Lino Lakes does not currently have municipal utilities available along the 400 <br />block of Ash Street (CR J/CSAH 32). The City of Shoreview has municipal utilities along the south side <br />of Ash Street (CR J/CSAH 32); and <br /> <br />WHEREAS, the Individual Subsurface Treatment System of the property at 465 Ash Street, Lino Lakes, <br />MN is failing; and <br /> <br />WHEREAS, the property owner at 465 Ash Street, Lino Lakes, MN has requested to connect to the City <br />of Shoreview’s municipal utilities; and <br /> <br />WHEREAS, Lino Lakes represents that only 465 Ash Street, Lino Lakes, MN would be connected to the <br />City of Shoreview’s municipal system under this agreement. This area of Lino Lakes is planned to be <br />served in utility service Stage 2A (2020-2025) as outlined in the City of Lino Lake’s 2030 <br />Comprehensive Plan. Upon extension of Lino Lake’s municipal utilities this property will be required to <br />connect to the Lino Lakes system; and <br /> <br />WHEREAS, the property of 465 Ash Street, Lino Lakes, MN shall not be subdivided while connected to <br />the City of Shoreview’s municipal system; and <br /> <br />WHEREAS, the parties agree that it is the responsibility of the property owner to pay the City of <br />Shoreview’s utility connection fees, and obtain required permits from regulatory agencies for the <br />construction of service; and <br /> <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter into joint powers <br />agreements for the joint exercise of powers common to each. <br /> <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br /> <br /> <br />I.
