<br />LIQUOR VIOLATIONS HEARING <br /> <br /> <br /> <br />STAFF ORIGINATOR: Public Safety Director John Swenson <br /> <br />HEARING DATE: June 11, 2018 <br /> <br />TOPIC: Liquor License Violation – Don Julio’s <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />BACKGROUND <br /> <br />On November 21, 2017, members of the Police Division conducted alcohol compliance checks <br />to ensure that licensed businesses in Lino Lakes were not furnishing alcohol to minors. These <br />compliance checks were conducted by an underage employee of the Public Safety Department <br />under the supervision of two police officers. <br /> <br />At approximately 8:43 PM on November 21, 2017, the underage person entered Don Julio’s <br />(701 Apollo Dr., Suite 120) and went to the bar where this person ordered, was served and paid <br />for a beer. The bartender who served the underage person was later identified as Samuel <br />Hernandez. Mr. Hernandez was charged with Furnishing Alcohol to a Person Under 21 <br />(340A.503 Subd. 2) which is a gross misdemeanor. Mr. Hernandez plead guilty to this offense <br />February 13, 2018 in Anoka County District Court. <br /> <br />On February 18, 2018 at 11:55 PM, police staff responded to Don Julio’s (701 Apollo Dr., <br />Suite 120) to check the welfare of a female caller. The female called Anoka County Dispatch <br />and made odd comments, leading the dispatcher to believe there was problem. Upon the police <br />officers arrival at the business they found the business to be closed, but the front entrance was <br />unlocked. The police officers entered the business and interrupted an in-progress sexual <br />assault. During the course of the investigation of the sexual assault, it was determined that the <br />female victim of the sexual assault was 20 years. The victim had purchased and was served <br />alcohol from two different employees’ of Don Julio’s. <br /> <br />One of the employees (Simon Vicente) admitted to furnishing alcohol to the underage victim <br />during the course of the investigations. Mr. Vicente furnished the victim with alcohol at least <br />two times on February 18th with at least one of those occurring after the business closed at 10 <br />PM on February 18, 2018. Mr. Vicente was charged with Criminal Sexual Conduct in the <br />Third Degree (609.344 Subd. 1c) which is a felony. Mr. Vincente plead guilty to this offense <br />April 3, 2018 in Anoka County District Court. <br /> <br />The other employee involved (Erlin Perez) also admitted to furnishing alcohol to the underage <br />victim and another person with the victim, during the course of the investigation. Mr. Perez <br />was charged with Furnishing Alcohol to a Person Under 21 (340A.503 Subd.2). Mr. Perez <br />failed to appear in Anoka County District Court on May 15, 2018 for his first appearance on <br />this case; therefore, a warrant was issued for his arrest. <br /> <br />Since November 21, 2017 staff is aware of three different employees of Don Julio’s who have <br />provided alcohol to underage customers. One of the underage customers that was furnished
