MN statute 340A.501 Responsibility of Licensee <br />states” <br /> Every licensee is responsible for the conduct in the licensed establishment and any sale <br />of alcoholic beverage by any employee authorized to sell alcoholic beverages in the <br />establishment is the act of the licensee for the purpose of all provisions of this chapter except <br />sections 340A.701, 340A.702, and 340A.703. <br /> <br />Below is a best practices grid to assist Council when reviewing liquor license violation cases <br />within a one year time frame. The Council is not obligated to following this grid it is provided <br />for Council discussion. <br /> <br /> 1st Violation 2nd Violation 3rd Violation 4th Violation <br />Intoxicating liquor and <br />Tobacco licensee $500 Civil Penalty <br />$1,000 Civil <br />Penalty & 5 days <br />suspension <br />$2,000 Civil <br />Penalty & 10 days <br />suspension <br />Revocation <br /> <br />RECOMMENDATION <br /> <br />Staff recommends a $2,000 civil penalty and 10 days suspension of the City license to sell <br />intoxicating liquor is recommended. <br /> <br />ATTACHMENTS <br /> <br />Section 701.01 of the City Code <br />Minnesota State Statute 340A.501 & 340A.503 <br /> <br />
