<br /> <br />DATE: June 7, 2023 <br /> <br />TO: Park Board <br /> <br />FROM: Rick DeGardner, Public Services Director <br /> <br />RE: Easement Vacation – Shores of Marshan Lake Boardwalk <br /> <br /> <br />The boardwalk section in the Shores of Marshan development was built in 1995. The original <br />intent of the boardwalk was to continue northward resulting in an eventual circular loop around <br />Marshan Lake, but the concept was eventually abandoned. <br /> <br />The continued deterioration and heaving of the aging boardwalk sections became more of a safety <br />issue in 2017, with “Caution-Uneven Surface” signs being installed. In July 2019 Park Maintenance <br />staff placed barricades at both entrances, essentially closing down the Marshan Boardwalk. <br />Subsequently, the entire boardwalk section (approximately 700 feet), along with the bituminous <br />pathways leading to Stagecoach Trail, were removed in December 2020. <br /> <br />With the removal of the boardwalk and trail sections, there is no feasible plan to replace this trail <br />segment. Replacement costs would amount to well over $100,000. If no trail is ever envisioned or <br />needed, there is no need to retain the trail easements for public purposes. In order to vacate the <br />trail easements, the Park Board needs to approve a recommendation that the trail easements are, <br />“no longer needed for a public purpose.” <br /> <br />114
