1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />_______________________________________________________________________________ <br />[Above space reserved for recording data] <br /> <br />SECOND AMENDMENT TO OPEN SPACE EASEMENT <br /> <br />THIS SECOND AMENDMENT TO OPEN SPACE EASEMENT (“Amendment”) is made as of <br />July ___, 2024, by and between U.S. Home, LLC, a Delaware limited liability company, as <br />successor by conversion to U.S. Home Corporation, (“Grantor”) and the City of Lino Lakes, a <br />municipal corporation under the laws of Minnesota (“Grantee”). <br /> <br />Recitals <br /> <br />A. Grantor previously conveyed open space easements to the City by virtue of the following <br />Open Space Easement Agreements recorded in the office of the Anoka County Recorder <br />(collectively, and together with the First Amendment noted below, the "Open Space Easements"): <br /> <br />Open Space Easement Agreement recorded as Document No. 2222874.006; <br />Open Space Easement Agreement recorded as Document No. 2340590.007; <br />Open Space Easement Agreement recorded as Document No. 2390651.001; and <br />Open Space Easement Agreement recorded as Document No. 2401558.006. <br /> <br /> <br />B. Grantor and Grantee amended the Open Space Easements pursuant to that certain <br />Amendment to Open Space Easement recorded in the office of the Anoka County Recorder on <br />May 29, 2024 as Document No. 2414612.001 (the “First Amendment”) to clarify the “Easement <br />Area” intended to be conveyed by the Open Space Easements. <br /> <br />C. Grantor and Grantee now desire to further clarify the “Easement Area” intended to be <br />conveyed by the Open Space Easements and therefore, for good and valuable consideration, <br />Grantor and Grantee hereby agree on the terms and conditions set forth herein. <br /> <br /> Terms of Amendment <br /> <br />1. Release of Outlot C, WATERMARK 5TH ADDITION. Tract 3 of Section 1 of the First <br />Amendment described, in part, that Outlot C, WATERMARK 5TH ADDITION, according to the <br />recorded plat thereof, was encumbered by the Easement Area. Grantor and Grantee hereby <br />acknowledge that Outlot C, WATERMARK 5TH ADDITION is being or has been replatted <br />pursuant to the Plat of WATERMARK 7TH ADDITION, and in connection therewith Grantor and <br />Grantee are entering into a separate Open Space Easement Agreement with respect to portions of
