WHEREAS, the City received a land use application for Linda Avenue Addition <br />preliminary plat ("Preliminary Plat"); and <br />WHEREAS, City staff completed review of the Preliminary Plat based on the following <br />information: <br />• Boundary & Topographic Survey with Resource Inventory prepared by Kurth Surveying, <br />Inc. dated April 9, 2024 <br />• Boundary & Topographic Survey with Tree Inventory & Removals prepared by Kurth <br />Surveying, Inc. dated April 9, 2024 <br />• Preliminary Plat prepared by Kurth Surveying, Inc. dated April 9, 2024 <br />• Civil Plan Set prepared by Plowe Engineering, Inc. dated April 9, 2024 <br />• Landscape Plan prepared by Plowe Engineering, Inc. dated April 9, 2024 <br />• Report of Geotechnical Exploration prepared by ITCO Allied Engineering Company <br />dated August 22, 2023 <br />• Wetland Delineation Report prepared by Kjolhaug Environmental Services Company, <br />Inc. dated August 17, 2023 <br />• WCA Notice of Decision dated October 23, 2023; and <br />WHEREAS, the Planning & Zoning Board held a public hearing on May 8, 2024 and <br />recommended approval of the Preliminary Plat. <br />NOW, THEREFORE,, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: <br />Per Section 1001.013, Premature Subdivision: <br />(1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to <br />the following criteria shall be denied by the City Council. <br />(2) Conditions for establishing a premature subdivision. A subdivision maybe deemed <br />premature should any of the following conditions not be met. <br />(a) Consistency with the Comprehensive Plan. Including any of the following: <br />1. Land use plan; <br />2. Transportation plan; <br />3. Utility (sewer and water) plans; <br />4. Local water management plan; <br />1 <br />
