CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 6A <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br />MEETING DATE: August 12, 2024 <br />TOPIC: PUBLIC HEARING: Consider 151 Reading of Ordinance No. 12-24, <br />Vacating Drainage & Utility Easement, 904 Kelly Street, Lot 11, <br />Block 3, Pine Glen 2nd Addition <br />VOTE REQUIRED: Super Majority <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 15t Reading of Ordinance No. 12-24, <br />vacating Drainage and Utility easement, 904 Kelly Street, Lot 11, Block 3, Pine Glen 2nd <br />Addition. <br />BACKGROUND <br />904 Kelly Street a residential parcel owned by Jody and Jesse Fronek. The property owner <br />submitted a land use application requesting the vacation, of a portion, of a drainage easement <br />on their property for the installation of an above ground pool. <br />The drainage and utility easement was dedicated to the City over the Great River Energy <br />power easement with the Pine Glen 2nd Addition plat. The City doesn't allow for structures / <br />pools to be located within drainage and utility easements. The owner would like to vacate a <br />portion of the easement area to install an above ground pool. The property owner has an <br />encroachment agreement with Great River Energy and has coordinated setbacks through <br />them. <br />The Drainage and Utility Easement Vacation Description Sketch prepared by Carlson McCain, <br />Inc. received on July 1, 2024 details the proposed drainage and utility area to be vacated. <br />The second reading of the ordinance is scheduled for August 26, 2024. <br />RECOMMENDATION <br />Staff is recommending approval of the 1st Reading of Ordinance No. 12-24 Vacating Drainage <br />& Utility Easements, 904 Kelly Street, Lot 11, Block 3, Pine Glen 2nd Addition. <br />
