Council Minutes -10- July 8, 2024 <br />The City Attorney stated that in 2002, there was a State Court of Appeals decision that <br />challenged a Charter proposal in the City of Richfield, which is a Charter City, in the land use <br />planning area. And as a result of that decision, the Court of Appeals said that Charter Initiative <br />and Charter Amendments in the area of land use planning are largely preempted by the <br />Municipal Planning Act and the Metropolitan Land Planning Act Chapters 469 and 473. He said <br />that this and other legal cases over the last 20 or 30 years will be reviewed. He stated that he is <br />not prepared tonight to offer up deep analysis, because these the petitions were recently <br />received. But it's necessary to take that second step. <br />A. Motion to adopt Resolution No. 24-95, Regarding Technical Sufficiency of a Petition Under <br />City Charter, Chapter 5. Initiative, Referendum and Recall, Section 5.03.
