The Interim City Administrator's compensation shall be subject to federal and state income tax <br />withholding, FICA, and Medicare deductions. As a temporary employee, the Interim City <br />Administrator's compensation will not be subject to deductions for PERA. The position of <br />Interim City Administrator is an executive, exempt position under the Fair Labor Standards Act <br />and shall not be eligible for cash overtime or compensatory time in lieu of overtime. The Interim <br />City Administrator shall earn Earned Sick and Safe Time (ESST) leave at a rate of one hour of ESST <br />per 30 hours worked, which may be used in accordance with state law. <br />In recognition of the fact the Interim City Administrator's employment is temporary, the Interim <br />City Administrator shall not be eligible for, nor shall he receive any fringe benefits from the City <br />of City of Lino Lakes except as enumerated in the preceding paragraph. Therefore, by way of <br />example and without limitation, the Interim City Administrator shall not be eligible for group <br />insurance benefits, paid holidays, vacation, PTO, severance, or City retirement benefits. <br />6. EMPLOYMENT-AT-WILL/TERMINATION. Notwithstanding any statute, ordinance, or rule, the City <br />and Interim City Administrator acknowledge and agree that the position of Interim City <br />Administrator is an employee -at -will position of a temporary nature. Neither the Interim City <br />Administrator nor the City is bound to continue the employment relationship if either chooses, <br />at its will, to end the relationship at any time, with or without cause. Neither party shall be <br />entitled to any type of hearing to appeal or challenge the determination of the other party to <br />terminate the employment relationship. <br />The City shall be required to give the Interim City Administrator not less than fourteen (14) days <br />advance written notice of termination of employment. The Interim City Administrator shall <br />provide to the City fourteen (14) days written notice of his intention to voluntarily terminate his <br />employment with the City, unless the City agrees to decrease the amount of notice time. <br />The Interim City Administrator agrees that he will not voluntarily terminate this Employment <br />Agreement within two (2) months of the commencement date listed in Paragraph 2. <br />7. INDEMNIFICATION. The City will defend and indemnify the Interim City Administrator pursuant <br />to Minn. Stat. 466.07 and 465.76. In addition, the City will defend, hold harmless, and indemnify <br />the Interim City Administrator from all claims based on tort, civil damages, penalties, fines, and <br />claims based on violation of statutes, ordinances, and rules, provided that he was acting in good <br />faith in the performance of the duties of the position. <br />8. GENERAL PROVISIONS: <br />i) NOTICES.
