Memorandum of Understanding Between <br />North Oaks Company (NOC), Vadnais Lake Area <br />Watershed Management Organization (VLAWMO) and <br />City of Lino Lakes (City) <br />This Memorandum of Understanding ("MOU") is made and entered into by and <br />between the Vadnais Lake Area Watershed Management Organization <br />("VLAWMO") and City of Lino Lakes ("City") and North Oaks Company (NOC) <br />each acting by and through its duly authorized governing bodies. <br />Whereas, NOC, VLAWMO and the City mutually desire to partner on a <br />feasibility study ("Study") to assess and evaluate three key components related to the <br />potential water quality treatment practice within the Wilkinson Lake Subwatershed in <br />the City of Lino Lakes and the VLAWMO watershed; <br />Whereas, the NOC is considering development of its property located Northeast of Wilkinson <br />Lake within the City of Lino Lakes which directly drains to the Lake; <br />Whereas, Wilkinson Lake has been identified by the MPCA to be impaired for excess <br />nutrient loading; <br />Whereas, this Study is separate from the NOC development itself, synergies may be <br />leveraged in terms of construction timing and cost reduction for mobilization and <br />contracting. Projects considered in the Study must exceed the NOC development <br />requirements; <br />Whereas, An area adjacent to the NOC proposed development site holds potential for <br />implementing "above and beyond" water quality treatment practice to address these <br />concerns prior to discharge; <br />Whereas, the Study partners including the NOC, City and VLAWMO have reviewed <br />the request for services for development of the Study from ISG Inc. dated <br />(Attachment 1) and find that it provides the necessary work items to achieve its <br />desired Study outcomes; <br />Whereas, participation in financial partnership in the development of this Study does <br />not commit any of the partners to further fund implementation of any practices <br />identified in Study; <br />Whereas, the parties wish to clearly define their respective roles in the development <br />and completion of this Study; <br />Now, therefore, the parties hereby agree to enter into this MOU and to comply with <br />the following processes with respect to the Study: <br />DRAFT #2- Memorandum of Understanding- ISG Feasibility Study Nov. 26, 2024 <br />
