FIRST AMENDMENT OF AGREEMENT FOR BUILDING DEPARTMENT SERVICES BETWEEN CITY OF LINO LAKES, MINNESOTA AND MNSPECT, LLC THIS FIRST AMENDMENT OF AGREEMENT FOR BUILDING DEPARTMENT SERVICES is made effective as of the date of the last signature below by and between City of Lino Lakes, Minnesota (City) and MNSPECT, LLC, a wholly owned subsidiary of SAFEbuilt, LLC, (Consultant). Municipality and Consultant shall be jointly referred to as the "Parties". RECITALS AND REPRESENTATIONS WHEREAS, Parties entered into an Agreement for Building Department Services (Agreement), by which both Parties established the terms and conditions for service delivery on July 28, 2020; and WHEREAS, pursuant to Section 7 of Agreement, modifications shall require a written agreement signed by both parties; and WHEREAS, Parties find it mutually beneficial to modify the Agreement to include additional services (Additional Services) not included in the original scope of services. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, and other good and valuable consideration, the receipt and adequacy of which are acknowledged, the Parties agree as follows: The above recitals are acknowledged as true and correct and are incorporated herein. Section 1. Inspection Services., is hereby amended to include the following: D. Plan Review services on an add needed basis including the following: Provide plan review services electronically or in the traditional paper format. Review plans for compliance with adopted building codes, local building amendments or building ordinances. Be available for pre -submittal meetings by appointment. Coordinate plan review tracking, reporting, and interaction with applicable departments. Provide feedback to keep plan review process on schedule. Communicate plan review findings and recommendations in writing. Return a set of finalized plans and all supporting documentation. Provide review of plan revisions and remain available to applicant after the review is complete. Consultant will return plans and supporting documents. Designated Building Official. Individual who meets the statutory qualifications for a Designated Building Official found in the relevant Minnesota Statutes and Rules to serve as the City's Designated Building Official during times when the City does not have a satisfactory internal designee to serve as the City's Designated Building Official. During the time inspector is acting as the Designated Building Official, inspector shall be responsible for all duties set forth in Minnesota Rules, Chapter 1300. Certified Building Official with State Delegation — Provide inspections and Plan Review of "Public Buildings and State Licensed Facilities" as described in MN Statute 32613.103 G. Certified Building Official —Provides inspections of Commercial Projects
