CITY COUNCIL <br />WORK SESSION STAFF REPORT <br />ITEM NO. 9 <br />STAFF ORIGINATOR: Michael Grochala, Community Development Director <br />WORK SESSION DATE: April 7, 2025 <br />TOPIC: Water Treatment Plant Construction - North Building Setback. <br />BACKGROUND <br />Construction of the Water Treatment Plant has been progressing steadily over the past six <br />months. To date, the raw water mains along Birch Street have been installed and relocation of <br />the sanitary sewer and water main across the site has been completed. Construction of the <br />clearwell tank and backwash tanks are nearly complete. <br />However, WSB has informed staff that do to a coordinate error the clearwell structure <br />encroaches approximately 4 feet into the Birch Street front yard setback. This reduced the <br />building setback from 50' to 46' from the Birch Street right-of-way. Approximately 36' of <br />building remains to be constructed along this same line to the west. The balance of the <br />building to the east jogs to the south and will meet the 50' setback. <br />Upon notification of the error, City staff requested WSB complete an additional Quality <br />Assurance/Quality Control review of all plans to ensure that no additional complications would <br />result from the shift. A memo from WSB outlining how the error originated and how it impacts <br />site development is attached. Representatives of WSB will be present at the meeting to discuss <br />the issue. <br />Based on the WSB review it appears that the primary issue will be conformance with the zoning <br />code. The property is in the PSP, Public/Semi Public zoning district. The setback from a major <br />collector or arterial street is 50 feet. Fortunately, the setback encroachment is facing Birch <br />Street, which has a much wider right-of-way than typical local roads. The total right-of-way <br />width for Birch Street is 120'. Additionally, the 46' is still greater than the typical 40' arterial <br />road setback required for adjacent properties in the area including Wellhouse No. 3, located <br />immediately to the west.
