include, but is not limited to, proposed and final contours with adequate <br />elevation shots to show conformance, property irons (to be exposed in <br />field), low floor and low opening elevations, and the 100-Year High Water <br />Level (HWL) of all ponds, lakes, and wetland areas. The files shall be drawn <br />in Anoka County NAD 83 Coordinate system and provided in both AutoCAD <br />.dwg and Adobe .pdf file formats. The plans shall include accurate locations, <br />dimensions, elevations, grades, slopes and all other pertinent information <br />concerning the complete work. Developer shall also submit certified <br />compaction testing results for the site grading operations. <br />B. A summary of the record plan attribute data for the storm sewer, water main, <br />and sanitary sewer structures and pipes shall be submitted in the form of <br />an Excel Spreadsheet as provided by the City Engineer. <br />C. No securities will be fully released until all record drawings have been <br />submitted and accepted by the City Engineer. <br />VI. COMPLETION DATE. <br />If, subject to Force Majeure Delay, the activities authorized by site and building <br />plan approval are not initiated within twelve (12) months from the Effective <br />Date, then Developer will need to start the site and building plan approval <br />process from the beginning. If, subject to Force Majeure Delay, after twenty- <br />four (24) months from the Effective Date (the "Completion Date") Developer <br />has not substantially completed the On -Site Work and Off -Site Work, the City <br />reserves the right to use securities to address site issues to ensure <br />compliance with City Codes. <br />For purposes of this Agreement, the terms "substantially completed" or <br />"substantial completion" in reference to the On -Site Work and/or <br />Improvements shall mean and refer to the completion of all On -Site Work <br />(other than immaterial punch list items) without material deviation from the <br />Plans. <br />For the purposes of this Agreement, the term "Force Majeure Delay" <br />means delays, outside the reasonable control of the party claiming its <br />occurrence, which are the result of strikes, other labor troubles, severe or <br />prolonged bad weather, acts of God, global pandemic, epidemic, <br />government mandated quarantine or travel bans, government mandate <br />closures, fire or other casualty to the development contemplated by this <br />Agreement, litigation commenced by third parties which, by injunction or <br />other similar judicial action or by the exercise of reasonable discretion, <br />results in delays, or acts of any federal, state or local governmental unit, <br />shortages of materials, extraordinary restrictive governmental laws or <br />regulations (such as gas rationing), riots, war, military power, sabotage. The <br />time for performance of any obligation of Developer set forth in this <br />Agreement shall be extended for the period of the delay of such obligation <br />Aldi Site Performance Agreement page 5 of 13 <br />
