Natures Refuge North <br />Development Agreement <br />September 8, 2025 <br /> page 4 <br />e. Storm sewers shall be subject to the Trunk Utility Agreement. <br />f. Sanitary sewer mains shall be subject to the Trunk Utility Agreement. <br />g. Water mains shall be subject to the Trunk Utility Agreement. <br />h. The Developer shall place iron monuments at all lot, block, and outlot corners <br />and at all other angle points on boundary lines consistent with the final plat. <br />Iron monuments shall be placed after all street and lawn grading has been <br />completed in order to preserve the lot markers for future property owners. Lot <br />corner irons on the back property line shall be installed so that the top of the <br />iron corresponds to the finished ground elevation in accordance with the <br />approved grading plan. Guard stakes shall be appropriately installed to mark <br />these irons. <br />i. Landscaping and boulevard trees shall be furnished and installed in accordance <br />with the approved plans. The landscaping shall be maintained by the Developer <br />until accepted by the City’s Environmental Coordinator. <br />Developer shall be responsible for vegetative restoration of ponding areas, <br />outlots, wetland mitigation areas, and other native planting areas identified on <br />the plans in accordance with City Standard Specifications for Construction. <br />Developer shall provide a contract with a qualified firm for the establishment <br />and maintenance of all open space / native plant areas. Said contract shall cover <br />a minimum of the 3 year establishment period, from the date of planting. <br />j. The Developer shall arrange for all gas, telecommunications, cable, internet, <br />electric, and other necessary private utility services to the Subdivision in <br />accordance with City Code and State law. The utilities are required to be located <br />within a joint trench. Street light installations shall be initiated by the Developer <br />with City Engineer approval. The Developer is solely responsible for the cost of <br />private utility and internet installation. <br />k. The Developer shall install mailboxes in accordance with Federal and Postal <br />Service regulations. <br />l. The Developer shall install wetland buffer signs per City standard detail plates <br />prior to the issuance of building permits. <br />7. Time of Performance. The Developer shall install all required improvements <br />enumerated in Paragraph 6 by October 31, 2026. The Developer may request a <br />reasonable extension of time from the City. If the extension is granted, it shall be <br />conditioned upon updating the security posted by the Developer to reflect cost <br />increases and the extended completion date. <br />Page 85 of 168
