preceding phase consists of 40 or more lots. <br />The development is proposed to be constructed in two (2) phases. <br />(c) City attorney approval of the status of title/property ownership related to the final plat. <br />The City Attorney reviewed the title commitment and notes the title work shall be <br />updated to reflect proper ownership and plat signatures. <br />(d) Completed development contract. <br />A Development Agreement has been completed and shall be executed. <br />(e) Conditions attached to approval of the preliminary plat shall be fulfilled or secured by <br />the development agreement, as appropriate; and <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with a Development Agreement. <br />(f) All fees, charges and escrow related to the preliminary or final plat shall be paid in full. <br />All fees, charges and escrow related to the preliminary or final plat shall be paid in full <br />prior to release of the final plat mylars. <br />BE IT FURTHER RESOLVED the Natures Refuge North PUD Final Plan/Final Plat is <br />approved subject to the following conditions: <br />1. The conditions detailed Resolution No. 25-61 approving the Natures Refuge North PUD <br />Preliminary Plan and Preliminary Plat remain in effect. <br />2. A WMC Buffer Declaration shall be recorded over Outlots A, D and G. <br />3. A Conservation Easement shall be recorded over Outlots, A, C, D, and G. <br />4. A trail easement shall be recorded over the trails and corridors after the trails have been <br />constructed. <br />5. Outlots A, C, D, and G shall be deeded to a Homeowner's Association (HOA). <br />6. Outlot E shall be deeded to the City. <br />7. A homeowner's association will maintain the stormwater re -use system, lake/borrow <br />area, and open space and wetland buffers. <br />BE IT FURTHER RESOLVED the following items shall be addressed prior to release of the <br />final plat mylars: <br />1. All comments from the City Engineer memo related to the final plat dated August 6, <br />
