CITY OF LINO LAKES RESOLUTION NO. 25-148 RESOLUTION AUTHORIZING RELEASE OF TEMPORARY CONSTRUCTION EASEMENTS (21ST AVENUE) AND THE DEVELOPMENT CONTRACT FOR ALINO ADDITION WHEREAS, on September 8, 2025, the City Council passed Resolution No. 25-120 approving Clearwater Commons final plat (the “Plat”); and WHEREAS, the Plat included property that was part of ALINO Addition, platted in 2013, that was subject to a certain Development Contract (the “Contract”), recorded as Anoka County Document No. 2075334.004, filed for record on December 30, 2013; and WHEREAS, Article III of the Contract provides for its release upon completion of the Developers improvement; and WHEREAS, all such improvements have been completed; and WHEREAS, the property is subject to certain Permanent Utility and Drainage Easements and Temporary Construction Easements for the construction of 21st Avenue (the “Easements”), recorded as Anoka County Document No. 2084186.005, filed for record on June 13, 2014; and WHEREAS, the Easements provide for the expiration of the Temporary Easements upon substantial completion of 21st Avenue as determined by the City Engineer; and WHEREAS, 21st Avenue is substantially complete, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes approves the Release and Termination of the ALINO ADDITION Development Contract and the Release and Termination of the Temporary Construction Easements. BE IT FURTHER RESOLVED, that the Mayor and Clerk are hereby authorized to execute all necessary documents following review and approval of the City Attorney.
