CITY COUNCIL <br />STAFF REPORT <br />AGENDA ITEM 2.A. <br /> <br />STAFF ORIGINATOR: Tracy Thoma, Finance Director <br /> <br />MEETING DATE October 13, 2025 <br /> <br />AGENDA ITEM: Public Hearing, Approval of Resolution No. 25-139 Adopting the <br />Assessment Roll for Delinquent Utility Accounts <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br />The purpose of this agenda item is for the City Council to hold the assessment public hearing <br />for the 2025 Delinquent Utility Accounts. The proposed assessment roll (Exhibit A - to be <br />distributed at the Meeting) that is prepared for the public hearing includes the delinquent <br />utility balances by PID number and property street address information. <br /> <br />BACKGROUND <br />State Statutes 429.101 and 444.075 and Sections 401.3, 402.14, and 404.10 of the Lino Lakes <br />City Code state that a/the city may certify unpaid special charges, including those listed below, <br />to the County Auditor as a special assessment against the property. <br />• The recovery of payment of utility bills and other services, even if provided by a third <br />party <br />• Snow and weed elimination from streets or private property <br />• Nuisance charges <br />• Administrative citations <br />To recover unpaid special charges and delinquent accounts, the City must follow State Statute <br />429.101 procedures. Those procedures provide that the City must adopt a resolution declaring <br />the unpaid special charges and delinquent past due accounts to be assessed and establish a <br />date for the assessment hearing for those charges. On September 22, 2025, the Council <br />adopted a resolution declaring the costs to be assessed, ordering preparation of the <br />assessment rolls, and setting the date of the public hearing. A notice of public hearing was <br />published in the legal section of the Quad Community Press on September 30, 2025. <br /> <br />All property owners with unpaid delinquent accounts have been mailed a Notice of Hearing to <br />Certify Special Assessments, which included information pertinent to their property such as the <br />total proposed assessment amount and the interest rate.
