Page 29 <br /> <br />5. An employee who sustains a work-related injury or illness must inform their supervisor <br />immediately. A First Report of Injury form must be filed with the City. <br />6. Neither the City nor its insurance carrier will be liable for the payment of workers’ <br />compensation benefits for injuries that occur during an employee's voluntary <br />participation in off-duty recreational, social, or athletic activities sponsored by the City. <br />6.6 Sick Child/School Child Leave <br />In accordance with state law, the City provides the following leave for eligible employees. An <br />eligible employee is any regular full-time or part-time employee who has been employed with <br />the City for 12 months and has worked a minimum of 20 hours per week. For this section, <br />“child” is defined as being less than 18 years of age, or under 20 years of age and attending <br />secondary school. <br />1. Sick Child. City employees may use Sick Leave/ESST or PTO/ESST for absences due to the <br />illness of a child in the same way that employees are able to use Sick Leave/ESST or <br />PTO/ESST for their own illness. <br />2. School Child. City employees are granted up to 16 hours per school year to attend their <br />child’s school conferences or classroom activities when they cannot be scheduled during <br />non-work hours. Employees may take unpaid time or use paid leave for this purpose. <br />6.7 Funeral Leave <br />Regular full-time employees shall be granted paid funeral leave of up to: (1) five days for the <br />death of a spouse, child, or stepchild; (2) up to three days for a parent, stepparent, sibling, or <br />grandchild of the employee or employee’s spouse; and (3) one day for a grandparent, niece, or <br />nephew of the employee or employee’s spouse. <br />6.8 Military Leave <br />State and federal laws provide protection and benefits to city employees who are called to <br />military service, whether in the reserves or on active duty. Such employees are entitled to a <br />leave of absence without loss of pay, seniority status, efficiency rating, or benefits for the time <br />the employee is engaged in training or active service not exceeding a total of 15 workdays in <br />any calendar year. City compensation is in addition to the military pay for these 15 days, as per <br />MN Attorney General’s Opinion. <br />The leave of absence is only in the event the employee returns to employment with the city as <br />required upon being relieved from service or is prevented from returning by physical or mental <br />disability or other cause not the fault of the employee or is required by the proper authority to <br />continue in military or naval service beyond the fifteen-day paid leave of absence. Employees <br />on extended unpaid military leave will receive fifteen days paid leave of absence in each <br />calendar year, not to exceed five years. Where possible, notice is to be provided to the city at <br />least ten working days in advance of the requested leave. A training notice, signed orders, or <br />battle assembly schedule are examples of typical written notification to share with the city. <br />Page 90 of 166
