LIQUOR COMPLIANCE HEARINGNovember 25, 2013
DRAFT
1
CITY OF LINO LAKES
2
MINUTES
3
4
5
DATE:November 25, 2013
6
TIME STARTED: 6:15p.m.
7
TIME ENDED: 6:25p.m.
8
MEMBERS PRESENT: CouncilMembersRafferty,O’Donnell,
9
Roeser, Stoesz and Mayor Reinert
10
MEMBERS ABSENT: None
11
12
13Staff members present: City AdministratorJeff Karlson; Public Safety DirectorJohn Swenson;
14Police Captain Kelly McCarthy; and City Clerk, Julie Bartell
15
HEARING ON LIQUOR CODE VIOLATION
16
17
18Police Chief Swenson reported that the Police Department regularly conducts compliance
19checks at the city’s licensed liquor establishments. On August 28, 2013, a compliance check
20was conducted at The Tavern on Main and a violation occurred. The bartender served and took
21payment for beverages for two underage buyers. A ticket was issued and the offending
22bartender has since pled guilty and received a fine in court. He explained that the matter is now
23before the city council for consideration of city action on the violation. Based on the council
24approved Best Practices Grid, staff is recommending the imposition of a fine of $500 on the
25establishment.
26
27Tavern on Main owner and licensee Chad Wagner assured the council that he takes this matter
28very seriously and explained that he insists on liquor servicetraining for all his employees. He
29addresses an employee violation such as this with a suspension on the first violation and
30termination on the second.
31
32Mayor Reinert thanked Mr. Wagner for his explanation and indicated that the Tavern on Main is
33generally a good operation. He added that the council typically follows the Best Practice Grid
34when imposing a fine so the recommendation ($500 fine) will be forwarded for action.
35
36Action on the matter will be considered as part of the regular council meeting that will follow
37adjournment of the hearing.
38
39The meeting was adjourned at 6:25 p.m.
40
41These minutes were considered and approved at the regular City Council Meeting on December
429, 2013.
43
44
45
46__
47Julianne Bartell, City ClerkJeff Reinert, Mayor
48
