P17 <br />CITY COUNCIL WORK SESSION March 26, 2012 <br />DRAFT <br />46 council is supportive of the grant request and the mayor suggested that staff also seek a <br />47 letter of support from the city's state representatives, Runbeck and Chamberlain; the <br />48 mayor will communicate with the representatives and staff will follow up with a request. <br />49 <br />50 6A) Resolution No. 12 -29, Calling for a Hearing to Establish Cartway — Community <br />51 Development Director Grochala noted that the city received a petition to establish a <br />52 cartway from resident Adam Johnson, 2055 Otter Lake Drive. He lives at the end of a <br />53 public roadway just before a private bridge that provides access to other land, including ten <br />54 acres that Mr. Johnson owns. He has attempted to get access rights from the association <br />55 that controls the private roadway/bridge. Within the petition Mr. Johnson notes that he <br />56 proposes to use the land two to three times per week for walking and recreational driving. <br />57 <br />58 City Attorney Squires reviewed the cartway statute which basically allows for forced <br />59 access to a landlocked parcel across someone else's property, made applicable in cities in <br />60 2006. If the petition is proper, the law says the council shall grant the access. Setting a <br />61 hearing, as is called for this evening, is the first step in the process. The council can <br />62 decide upon route, determine damages, charge costs incurred to the city as well as impose <br />63 maintenance responsibilities as appropriate. The council may adopt the order and resolve <br />64 issues at the public hearing date but can take more time if that is necessary. <br />65 6B) 2012 Intersection Signal Improvements <br />66 i. Consider Resolution No. 12 -30, Approving Joint Powers Agreement with Anoka <br />67 County, Birch/Ware Signal Improvements <br />68 ii. Consider Resolution No. 12 -31, Approving Joint Powers Agreement with Anoka <br />69 County, Main/Lake Signal Improvements <br />70 <br />71 Community Development Director Grochala noted the two joint powers agreements with <br />72 Anoka County. Once these are authorized, the county will proceed with land <br />73 acquisitions. He reviewed the estimated project costs, noting a reduction from the <br />74 original estimate. The council will also be doing some roadway improvement on Lake <br />75 Drive.
