• The accident involves the loss of human life; or <br />• The driver receives a citation for a moving traffic violation arising from the <br />accident, which results in an injury or severe damage to one or more motor <br />vehicles. <br />A driver who is subject to post- accident testing must remain readily available for such <br />testing. Drivers who are not readily available for such testing may be deemed by the City <br />to have refused to submit to testing. <br />Drivers are required to submit to post - accident controlled substance testing as soon as <br />possible within 32 hours of the accident. If the driver is not tested within 32 hours after <br />the accident, the City will cease its attempts to test the driver and prepare and maintain on <br />file a record stating why the test was not promptly administered. <br />Drivers are required to submit to post- accident alcohol testing as soon as possible within <br />two hours; and in any event no more than eight hours after the accident. If the driver is <br />not tested within two hours after the accident, the City will prepare and maintain on file a <br />record stating why the test was not administered within that time. If the driver is not <br />tested within eight hours after the accident, the City will cease its attempts to test the <br />driver and prepare and maintain on file a record stating why the test was not administered. <br />In the event of an accident, it is possible that the driver will be directed to submit to a <br />breath, blood, or urine test for the use of alcohol or controlled substance administered by <br />a federal, state, or local law enforcement officer. Whenever such a test is conducted by a <br />law enforcement officer, the driver must contact the City and immediately report the <br />existence of the test, providing the name, badge number, and telephone number of the law <br />enforcement officer who conducted the test. <br />6. Random Testing. Random alcohol and controlled substance testing will be conducted as <br />follows: <br />• Alcohol testing will be administered at a number equal to or greater than 10% of the <br />average number of driver positions. Controlled substance testing will be performed at <br />a number equal to or greater than 50% of the average number of drivers. Under the <br />selected process used, each driver will have an equal chance of being tested each time <br />selections are made. Drivers may be selected for more than one test per year. <br />• Test will be unannounced and spread reasonably through the calendar year. <br />• Drivers selected for a random test will proceed immediately to the test site upon <br />notification of being selected. <br />• In the event a driver who is selected for a random test is on vacation or an extended <br />medical absence they will be tested when they return. <br />7. Emergency Call Back to Work Provisions. If an employee is called back to work for an <br />emergency and is suspected of being under the influence of drugs or alcohol, he or she <br />will not be allowed to work and arrangements for transportation to the employee's home <br />will be made. <br />8. Right of Refusal. Employees have the right to refuse requested tests. However, refusal to <br />submit to such tests will result in disciplinary action and will be considered in evaluating <br />38 <br />
