• <br />• <br />5. Nothing in this policy will be construed to limit or extend the maximum allowable <br />absence under the Family Medical Leave Act (FMLA). <br />C. Leave Donor Conditions <br />1. Employees may donate a minimum of eight hours or a maximum of 40 hours paid leave <br />provided they maintain a minimum balance of 80 hours of sick leave and 40 hours of <br />vacation leave. <br />2. Employees who donate leave shall adhere to the confidentiality requirement set forth <br />within the Leave Donation Form. Donations will remain anonymous to the recipient and <br />other employees. <br />3. No provisions of this policy or its administration shall be subject to a grievance under a <br />collective bargaining agreement. <br />D. Administrative Procedures <br />1. Eligible employees wishing to participate in this program should contact Administration <br />and request a "Donated Leave Request Form." If the employee is physically unable to <br />apply, a member of the applicant's family may apply on his or her behalf. <br />2. Appropriate documentation concerning the nature, severity, and anticipated duration of <br />the medical condition is required with the Donated Leave Request Form. <br />3. If the employee is found to be eligible for donated leave, Administration will notify <br />employees only giving the person's name and estimated number of days needed. The <br />notification shall not include confidential medical information. <br />4. Employees wishing to donate accrued leave shall submit a Leave Donation Authorization <br />Form to Administration. <br />5. Each hour of donor leave will be credited as an hour of leave for the recipient, regardless <br />of any differences in pay levels. <br />6. Finance will subtract surrendered leave from the donor's accrued balance and credit the <br />donated hours to the recipient's sick leave balance. <br />7. Donated leave hours will be processed in the order of the date on the Leave Donation <br />Program Authorization Form in eight hour increments, starting with the recipient's <br />department. Unused donated leave in will be returned to the donor. If there are multiple <br />donors, the excess leave will be returned on a prorated basis according to the amounts <br />donated. <br />8. Recipients will continue to accrue sick leave and vacation during the period of donated <br />leave. The recipient's accrued paid leave during the absence shall be utilized prior to the <br />donated leave. <br />E. Program Exceptions <br />Exceptions to these requirements may be approved by the City Administrator in rare <br />circumstances. The City Administrator shall have the right to deny or limit the donation of leave <br />or use of donated leave if it is determined to be in the best interests of the City of Lino Lakes. <br />18 <br />P54 <br />
