WS -3 <br />Issues to Consider <br />1. City liability. <br />2. Neighborhood response to noise. <br />3. Hours /days of operation. <br />4. Alcohol use outdoors. The city's zoning ordinance addresses outdoor dining <br />facilities as a Conditional Use, requiring that access to the outdoor area is <br />provided only through the principal building. This restriction prohibits people <br />from leaving the premises with alcoholic beverages. The Legion has indicated that <br />it will not allow drinks to be brought outside, but that may be difficult to enforce. <br />5. Equipment that the Legion may have in conjunction with the activity, such as <br />spectator seating, or equipment that the city may require, such as trash containers. <br />6. A cutoff date and ability to break the lease with notice. <br />The city attorney advised that any restrictions the city wishes to impose could be <br />addressed in the lease as well as anything else the City Council may want to include if <br />the decision is made to lease the property. <br />The Legion could be required to apply for a Conditional Use Permit and submit a site <br />plan showing location and boundaries of the horseshoe pits, and address any <br />restrictions such as fencing or screening the city may wish to impose. <br />
