FINAL DRAFT Lino Lakes Animal Ordinance <br />d. directed toward a person or animal who was willfully trespassing, committing <br />another tort, committing a crime, or attempting to commit a crime, on premises occupied <br />by the animal's owner; <br />e. provoked; or <br />f. done to defend or protect itself or a human being within its immediate vicinity <br />from an unjustified attack or assault. <br />PUBLIC NUISANCE ANIMAL. An animal that: <br />a. is maintained in a manner that violates §503.11; <br />b. by virtue of number or types of animals maintained, is offensive or dangerous to <br />the public health, safety or welfare; or <br />c. has been the subject of a violation of this chapter more than two times in a 24- <br />month period. <br />UNDER RESTRAINT. An animal that is: (a) within a private motor vehicle of a person, <br />owning, harboring or keeping the animal; or (b) controlled by a leash not exceeding six <br />feet in length. <br />VETERINARY HOSPITAL. A place for the treatment, hospitalization, surgery, care <br />and boarding of animals and birds, under the direction of one or more licensed <br />veterinarians. <br />WILD ANIMAL. Any of the following: <br />a. front -fanged venomous snakes, including the viperidae and elapidae families of <br />snakes, such as rattlesnakes and cobras; <br />b. snakes over 8 feet in length; <br />c. reptiles that have the physical ability as an adult to cause substantial bodily injury <br />as defined in Minn. Stat. §609.02, subd. 7a, to humans and /or domestic animals, such as <br />python snakes and crocodilians; <br />d. animals that can transmit rabies and cannot be vaccinated against rabies, except <br />domestic animals such as cows; <br />e. animals that as a breed are considered wild by nature because of breeding, <br />history, character, habit, or disposition; and <br />f. animals that have at least 25 percent of their heritage from animals specified in <br />subparagraph e, above. <br />Amended 3/15/05 Page 3 of 15 <br />
