WORK SESSION STAFF REPORT <br />Work Session Item No. 6 <br />Date: Council Work Session, Wednesday, March 23, 2005 <br />To: City Council <br />From: Gordon Heitke, City Administrator <br />Re: Joint Powers Agreement Request — Pine Hollow, Circle Pines <br />Background: <br />The City of Circle Pines is requesting the two cities to enter into a joint powers <br />agreement (JPA) to allow for the City of Lino Lakes to provide sanitary sewer service for <br />a 52 unit single- family housing development known as Pine Hollow. Prior to entering <br />into a JPA with Lino Lakes, sanitary sewer lines were constructed by the developer. <br />After further research, it has been determined that these lines were constructed on private <br />property, without permission and obtaining necessary easements from the property <br />owner. The City of Lino Lakes should not consider executing a JPA until such time that <br />adequate easements are obtained from the private property owner, or the sanitary sewer <br />lines are proposed to be relocated and proper easements are obtained. <br />Another issue of concern in approving another JPA with Circle Pines at this time relates <br />to the recent violation by Circle Pines of the JPA for Rice Lake Estates Park. The City of <br />Lino Lakes entered into a JPA with the City of Circle Pines in 1998 in which the City of <br />Lino Lakes leased approximately one acre of land for 25 years with an extension option <br />of 15 years and expended $45,000 in playground equipment, a basketball court and other <br />site amenities. On September 22, 2004 the City of Circle Pines removed the playground <br />equipment without notifying Lino Lakes staff. The sudden destruction of the facilities <br />has left residents of Rice Lake Estates without a park. Staff is presently working with <br />Circle Pines staff to determine how and when this situation will be remedied. The <br />response of the City of Circle Pines is attached. <br />1 <br />
