Blair, City Clerk <br />Re: Issue of Bar Closing Hours -- <br />Consider Request from Miller's on Main <br />Current Status of Closing Hours in Lino Lakes <br />Effective July 1, 2003, the state legislature made it possible for on -sale liquor license <br />holders to keep their establishments open until 2 a.m., so long as this is consistent with <br />the ordinances of individual cities. Any establishment wishing to remain open until 2 <br />a.m. must make application for this license and have this approved by their local <br />municipality, as well as the state, and pay a fee. <br />Some cities find themselves in a position of having their Code inconsistent with the new <br />state law. For cities that did not have hours of operation specifically listed in their <br />ordinance, the July 1, 2003 effective date of the legislation resulted in a de facto closing <br />time of 2 a.m., provided individual establishments made application for the license. <br />However, our City Code provides in relevant part that: 1) State law is adopted, 2) the City <br />of Lino Lakes may be more restrictive than state law, where allowed, and 3) the hours of <br />operation are specifically listed, providing for a 1 a.m. closing time in the city. <br />Therefore, we are at a closing time of 1 a.m., and our ordinance is consistent with the <br />state law. If the Council wishes to consider allowing a 2 a.m. closing time then, an <br />ordinance change would be necessary to accomplish this. <br />We have received one application, from Miller's on Main, to consider the 2 a.m. closing <br />hours. Therefore, we have put consideration of a 2 a.m. closing time on the Council work <br />session agenda. I have notified the other on -sale establishments of the request and that <br />the Council will discuss this matter at the August 6, 2003 work session. <br />Status of Surrounding Communities <br />The State's Department of Public Safety website contains a link that lists the <br />establishments who have currently applied for and received the 2 a.m. closing license. <br />Communities which have made ordinance changes very recently may not yet be <br />represented on the list. <br />
