• <br />• <br />• <br />STAFF ORIGNINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1B <br />Jean Viger, Deputy Clerk <br />June 27, 2005 <br />Consider Resolution 05 -80, Approving <br />Application for Temporary 3.2 Percent Malt <br />Liquor (Beer) License, a Cabaret License and an <br />Exemption for Gambling Permit for the Annual <br />St. Joseph Catholic Church August Festival. <br />Simple Majority (3/5 Vote) <br />St. Joseph Catholic Church is hosting its armual August Festival on Saturday, August 13 <br />and Sunday, August 14, 2005. As part of the celebration, food and beverages, including <br />beer, will be served. The Lino Lakes City Code, 702.02, Subd. 3, states "temporary on- <br />sale licenses shall be granted only to bona fide clubs and charitable, religious and non- <br />profit organizations for the sale of beer for consumption on the premises only ". <br />In addition, the parish has made application to acquire a cabaret license and approval for <br />an exemption for lawful gambling permit. A dance will be held Saturday, August 13, <br />from 5:00 p.m. to 10:00 p.m. and Sunday, August 14, from 11:00 a.m. to 5:00 p.m. Non- <br />profit organizations are allowed, under State Gambling Statutes, to apply for an <br />exemption permit if they conduct fewer than five (5) gambling occasions per year. St. <br />Joseph Catholic Church conducts fewer than five. <br />St. Joseph's has completed the necessary applications, submitted a current certificate of <br />insurance and paid the proper fees. The applications and the certificate of insurance are <br />on file in the city clerk's office. <br />The police department is conducting a background investigation and approval is <br />contingent upon a finding of no information that would require a recommendation of <br />denial. <br />OPTIONS: <br />1.
