CITY COUNCIL <br />AGENDA ITEM 3A <br /> <br /> <br />STAFF ORIG INATOR: Jeff Karlson <br /> <br />MEETING DATE: January 21, 2014 <br /> <br />TOPIC: Amendment to Section 2.6 of the CFD Joint Powers Agreement <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />The City Council is being asked to approve a n amendment to Section 2.6 of the Centennial Fire <br />District Joint Powers Agreement. <br /> <br />BACKGROUND <br /> <br />On November 19 , 2013, the Centennial Fire District Steering Committee voted in favor of <br />having each member city co nsider an amendment to Section 2.6 of the Join t Powers Agreement <br />(JPA), which would add the following language to the voting procedures: “However, passage <br />of a motion shall require an affirmative vote from one member of each member city.” <br /> <br />The Lino Lakes City Council approved the amendment on November 25 , 2013 . However, the <br />Circle Pines and Centerville City Council s did not vote in favor of the proposal. <br /> <br />The Steering Committee met again on December 12 and agreed to continue its effort to find <br />resolution and unanimously approved a 30 -day extension of the withdrawal period to allow the <br />three cities more time to reach an agreement on voting procedures. All three city councils <br />approved the extension. <br /> <br />The Steering Committee held another meeting on January 15 and voted in favor of forwarding <br />a recommend ation to the city councils that Section 2.6 be amended to include a provision <br />granting a “veto vote” where two Steering Committee members from any one city vote against <br />a motion, with a limit of four vetoes per city in any calendar year. <br /> <br />RECOMMENDATION <br /> <br />A pprove Resolution No. 14 -05 amend ing Section 2.6 of the Centennial Fire District J oint <br />Powers Agreement as proposed by the Steering Committee . <br /> <br />ATTACHMENT S <br /> <br />Resolution No. 14 -05 <br />Amended Section 2.6
