AGENDA ITEM 1B <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: September 26, 2005 <br />TOPIC: Consider Approving Application for Exempt <br />Permit for Lawful Gambling License, Anoka <br />County Pheasants Forever <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />The organization, Anoka County Pheasants Forever, has applied for an exempt permit to <br />conduct a raffle on February 26, 2006. Non - profit organizations are allowed, under the <br />State Gambling Statutes, to apply for an exempt from gambling license if they conduct <br />fewer than five (5) gambling occasions per calendar year. Anoka County Pheasants <br />Forever conducts fewer than five (5) per calendar and, therefore, remains exempt from <br />requiring a gambling license. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the <br />non - profit organizations applying for the exemption permit notify the city that they are <br />applying for the exemption. A copy of the application is on file in the city clerk's office, <br />along with proof of non - profit status. The police department is conducting a background <br />investigation on the CEO of the organization. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption upon favorable results of <br />the background investigation. <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />Option No. 1 <br />
