• <br />• <br />• <br />AGENDA ITEM 1C <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: September 26, 2005 <br />TOPIC: Consider Approving Application for Exempt <br />Permit from Lawful Gambling, Lino Lakes <br />Chapter of the Junior Chamber of Commerce <br />(Jaycees) <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />The Lino Lakes Chapter of the Junior Chamber of Commerce (Jaycees) has submitted an <br />application for exempt permit to conduct a raffle at the Officer Shawn Silvera Memorial <br />Benefit on Sunday, October 16, 2005. <br />All lawful gambling conducted in Minnesota requires authorization from the Minnesota <br />Gambling Control Board in the form of a license, exempt permit or excluded <br />authorization. An exempt permit may be issued to non - profit organizations conducting <br />lawful gambling activity on five or fewer days during a calendar year. The Jaycees <br />conducts fewer than five and are not required to secure a gambling license. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the <br />non - profit organizations applying for the exemption permit notify the City that they are <br />applying for the exemption. A copy of the application for exempt permit and a copy of <br />non -profit status are on file in the City Clerk's office. <br />The Lino Lakes Police Department conducted a background investigation and found no <br />reason to deny approval of the application. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption <br />2. Deny the application for exemption <br />RECOMMENDATION: <br />Option No. 1 <br />
