Anoka County Contract No. 2005 -0537 <br />• <br />• <br />JOINT POWERS AGREEMENT <br />FOR FINAL DESIGN AND LAND ACQUISITION <br />FOR THE RECONSTRUCTION OF <br />COUNTY STATE AID HIGHWAY 23 (LAKE DRIVE) AND I- 35W INTERCHANGE <br />COUNTY PROJECT NO. S.A.P. 02- 623 -13 <br />CITY PROJECT NO. S.A.P. 210 - 020 -04 <br />THIS AGREEMENT is made and entered into this day of , 2005, by <br />and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, <br />Anoka, Minnesota 55303, hereinafter referred to as "County ", and the City of Lino Lakes, 600 Town <br />Center Parkway, Lino Lakes, Minnesota 55014, hereinafter referred to as the "City ". <br />WITNESSETH <br />WHEREAS, the parties to this agreement agree it is in the best interest of the traveling public to <br />reconstruct the Interchange of I -35 and County State Aid Highway 23 (Lake Drive) as soon as possible; <br />and, <br />WHEREAS, the parties to this agreement consider it mutually desirable to prepare a final <br />engineering plans, cost estimate and proceed with land acquisition for the reconstruction of the <br />Interchange; and, <br />WHEREAS, Anoka County has jurisdiction over County State Aid Highway 23 (Lake Dr.); and, <br />WHEREAS, The Minnesota Department of Transportation has jurisdiction over I -35W; and, <br />WHEREAS, the parties agree that the City shall cause the final design study of the Interchange, <br />including replacement of the I -35W bridge, and roadway reconstruction; and, <br />WHEREAS, the parties have entered into a separate agreement for Interchange study, Preliminary <br />Design and Project Memorandum. <br />WHEREAS, the parties agree that it is in their best interest that the cost of said final design study <br />be shared; and, <br />WHEREAS, the City and County agree to share all costs for preparation of a final design report . <br />including but not limited to engineering plan alternatives and cost estimates; and, <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter into joint <br />powers agreements for the joint exercise of powers common to each. <br />1 <br />1�� <br />
