• <br />• <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br />I. PURPOSE <br />The parties have joined together for the purpose of preparing final engineering plans, <br />specifications and cost estimate and acquire the necessary land for the reconstruction of the Interchange <br />of I -35W and County State Aid Highway 23 (Lake Drive) including the bridge over I -35W. The County <br />project number for the reconstruction is S.A.P. 02- 623 -13. The City Project No. is S.A.P. 210 - 020 -04. <br />Said engineering plans, when completed, will be filed in the office of the Anoka County Highway <br />Department and are incorporated herein by reference. <br />II. METHOD <br />The City shall provide all engineering services for the final design of Anoka County Project <br />S.A.P. 02- 623 -13 in conformance with State Aid and County standards. The City shall provide all <br />professional services for the land acquisition required for Anoka County Project S.A.P. 02- 623 -13 in <br />conformance with applicable law. The City shall acquire and convey to the County all right of way and <br />easements along CSAH 23 (Lake Drive) for this project at no cost to the County. <br />M. COSTS <br />A. The contract cost of the work, or if the work is not contracted, the cost of all labor, <br />materials, and equipment rental required to do the work shall constitute the "actual costs" and shall be so <br />referred to herein. "Estimated costs" are good faith projections of costs which will be incurred for the <br />Final Design and Land Acquisition. Actual costs may vary from the estimated costs and actual costs are <br />what the parties are responsible for. <br />B. Participation in the cost of Final Design and Land Acquisition is as follows: <br />1. The County agrees to contribute Fifty percent (50 %) to the cost of the Final Design. <br />The estimated total cost of the Final Design is $575,480.00 as shown in Exhibit A. The cost to the <br />County is $287,740.00. <br />Acquisition. <br />2. The City shall pay for One hundred percent (100 %) to the cost of the Land <br />C. The City and County each agree that the allocation of all other costs to reconstruct the <br />Interchange including construction and construction engineering shall be determined under separate <br />agreement. <br />D. The County shall pay to the City the County's portion of the Final Design within thirty <br />(30) days after receipt of a voucher containing such information as the County may require, representing <br />that payments have been made by the City to the Engineer, SEH, Inc. for services. <br />IV. TERM <br />This Agreement shall continue until terminated as provided hereinafter. <br />
