PUD Concept Plan Review <br />Future land use applications may include: <br />Existing Pine Oaks Plat Vacation <br />Rezone property from R, Rural to PUD, Planned Unit Development <br />PUD Preliminary Plan/Preliminary Plat <br />PUD Final Plan/Final Plat <br />This staff report is based on the following submittals: <br />Applicant Narrative <br />Concept Plans prepared by Carlson McCain dated November 19, 2025 <br />Rare Plant Survey prepared by Midwest Natural Resources dated December 11, <br />2025 <br />History <br />Pine Oaks Addition was originally platted in 1980 with 49 lots; however, the <br />development was never constructed. The plat will need to be vacated. <br />The concept of Natures Refuge, which includes this Pine Oaks area, was first presented <br />to the City in 2006 as a conservation subdivision. The original site was 232 gross acres <br />(approximately 100 acres upland and 132 acres wetlands/conservation easements) and <br />278 single family units were proposed. A mandatory Environmental Assessment <br />Worksheet (EAW) was prepared because the 278 housing units exceeded the 250 <br />housing unit Environmental Review Record (ERR) threshold. It was determined the <br />project did not have the potential for significant environmental effects and the Council <br />passed Resolution No. 07-06 making a Negative Declaration on the Need for an EIS. <br />The original Natures Refuge did not materialize past the EAW process due to the decline <br />in the housing market and no preliminary plat was ever submitted. A smaller phase <br />(Natures Refuge) was approved in January 2022 with 60 single family units on 95 gross <br />acres. A second phase (Natures Refuge North) was approved in May 2025 with 94 single <br />family villa lots on 60 gross acres.
