4. The rural subdivision can demonstrate that each of the proposed lots can be <br />provided with a potable water supply. <br />The Harvest Grange preliminary plat will have an adequate water supply. <br />(e) Waste disposal systems. A proposed subdivision shall be served with adequate <br />waste disposal systems when: <br />1. The urban sewered subdivision is located inside the city's MUSA or is consistent <br />with the MUSA allocation criteria; <br />2. The city has sufficient MUSA and pipe capacity to serve the subdivision if <br />developed to its maximum density; <br />3. The subdivision will result in a sewer extension consistent with Lino Lakes <br />sewer plan and capital improvement plan; <br />4. A rural subdivision can demonstrate that each lot can be served by an <br />adequate sanitary sewer disposal system; and <br />5. A rural subdivision with a proposed communal sanitary sewer or water system <br />has an effective long range management and maintenance program with proper <br />financing. <br />The Harvest Grange preliminary plat will be served with an adequate waste disposal <br />system. <br />RECOMMENDATION <br />Staff recommends approval of the Harvest Grange rezoning and preliminary plat with <br />the following conditions: <br />1.Outlots A and B shall be owned and maintained by an HOA. <br />2.Outlot C shall be owned and maintained by the City. <br />3.HOA documents shall provide language allowing Street C to extend north to <br />th <br />serve potential future development at6795 20 Avenue. <br />4.Lots 10-15, and Lot 23, Block 1 do not meet the minimum lot area requirements. <br />a.All lots within the development shall meet the minimum lot area <br />requirements. <br />5.Local street right-of-way setbacks for the townhomes shall meet 30ft. <br />6.Rear lot line setbacks for the townhomes shall meet 30ft. <br />7.The Heritage Avenue cul de sac cannot exceed 500ft and shall be revised. <br />8.Street D shall have a temporary cul de sac at the north end. <br />9.Street A shall be platted as public right-of-way. <br />10.Private Street C exceeds 150ft and shall provide a turn-around at or near its <br />terminus. <br />11.The private street shall gain access from the public street and shall maintain the <br />street drainage with concrete curb and gutter per City Standard Specifications <br />for Construction. Private street access on urban and rural streets shall have at a <br />17 <br /> <br />
