DATED November 29, 2005 <br />MEMORANDUM OF UNDERSTANDING <br />FOR THE RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 14 (MAIN <br />STREET) BETWEEN I -35 W AND I -35 E IN THE CITIES OF CENTERVILLE AND <br />LINO LAKES, MINNESOTA <br />(S.P. 02- 614 -24) <br />This Memorandum of Understanding (MOU) is between the County of Anoka, State of Minnesota, a political <br />subdivision of the State of Minnesota, 2100 Third Avenue North, Anoka, Minnesota, 55303, hereinafter <br />referred to as "County ", and the City of Lino Lakes, a municipal corporation under the laws of the State <br />of Minnesota, 600 Town Center Parkway, Lino Lakes, Minnesota 55014 hereinafter referred to as the <br />"City". <br />The parties to this MOU agree in principle that construction of County State Project No. 02- 614 -24 referred <br />to as the "Project" is in the best interest of the traveling public and that the Preliminary Layout as shown in <br />Exhibit "A" defines the design of the Project. <br />It is agreed that the Exhibit "A" Layout dated July 29, 2005 has been reviewed and accepted by the parties <br />except as identified in this MOU and is suitable for preparation of final construction documents. Any <br />significant changes made hereafter to the design as presented in the Exhibit "A" Layout will require approval <br />by the parties as an amendment to this MOU or addressed in a separate Joint Powers Agreement (JPA) that <br />will formalize this MOU. These same changes will require a change in the cost share to include any <br />additional design engineering cost that may occur. <br />INTERSECTIONS: <br />As agreed by the parties, improvements to following City Street intersection have been incorporated in the <br />Exhibit "A" Layout design: <br />1. Woodlland Drive <br />2. 21" Avenue N <br />It is understood that future improvements may be required at the CSAH 14 and 21" Avenue N intersection to <br />accommodate improvements for the future interchange at I -35 E. It is understood that future improvements <br />will need to be made to CSAH 21 and County Road 54 in the future as development occurs. Improvements <br />may include but are not limited to: turn lanes, through lanes, extension of concrete medians. The parties will <br />meet jointly to consider any future improvements. The costs of these improvements will be determined at the <br />time of construction and may be shared by the County, City and Developer. <br />The intersection at 21' Avenue N will be limited to a % access condition (for 21" Ave., intersection will <br />allow right in, right out, left in, but no left out) until the interchange at I -35E is reconstructed or development <br />in the area desires to connect to Main Street at 21' Avenue N. and is expected to produce an unacceptable <br />level of service (LOS F) on Main Street.
