UTILITIES: <br />The parties agree that the Exhibit "A" Layout does include specific proposed utility locations. The City will <br />be responsible for the design of any sanitary sewer and water main improvements, which will be incorporated <br />in the project bid documents. The cost of the design and construction of these features will be the <br />responsibility of the City. The City's design of the sanitary sewer and water main utilities are to include <br />plans, specifications, and estimated quantities and cost. All construction documents must be submitted to the <br />County by April 30, 2006. <br />PERMITS: <br />The parties agree that the County will secure all necessary permits for this Project. The City agrees to <br />coordinate with the County in securing the permits required by the Rice Creek Watershed District. The City <br />also agrees to secure any permits required for improvements proposed by the City including utilities, and <br />streetscape items. <br />SUMMARY: <br />Upon acceptance and signatures by the parties of this MOU, a separate joint powers agreement for cost share <br />and maintenance will be prepared by the County for execution by the City and the County prior to acceptance <br />of bids for this project. The joint powers agreement to follow will formalize all estimated and actual cost <br />shares. The parties recognize the difficult nature of this project and every effort will be made to reduce the <br />impacts to adjoining properties.
