Second Reading and Passage of Ordinance Number 02 -11, Amending the <br />94 zoning ordinance requirements regarding Open Air Markets, Transient Merchants, and <br />95 Community Gardens — City Planner Smyser reported that the ordinance will update the city's zoning <br />96 ordinance to: 1) allow for community gardens in the city (on city land only) and establish a process <br />97 for obtaining an agreement to operate; 2) allow for open air markets in all zoning districts with the <br />98 issuance of a special event permit through the city; and 3) allow certain roadside activities in all <br />99 zoning districts with the issuance of a transient merchant license through the city. <br />100 <br />101 Council Member Rafferty moved to dispense with full reading of the ordinance. Council Member <br />102 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br />103 <br />104 Council Member Rafferty moved to approve second reading and passage of Ordinance No. 02 -1 1 as <br />105 presented. Council Member Roeser seconded the motion. Motion carried: Yeas; 5; Nays none. <br />106 <br />107 ii. Second Reading and Passage of Ordinance Number 01 -11, Amending City Code <br />108 Chapter 615 definition of the term Special Event to include Open Air Markets — City Planner <br />109 Smyser explained that the ordinance amends the city code to match the changes referred to above in <br />110 the zoning ordinance. <br />111 <br />112 Council Member O'Donnell moved to dispense with full reading of the ordinance. Council Member <br />113 Rafferty seconded the motion. Motion carried on a unanimous voice vote. <br />114 <br />1 15 Council Member O'Donnell moved to approve second reading and passage of Ordinance No. 01 -11 <br />1 1 6 as presented. Council Member Gallup seconded the motion. Motion carried: Yeas; 5; Nays none. <br />117 <br />118 iii. Resolution No. 11 -11, Summary Publication of Ordinance No. 02 -11. <br />119 <br />120 Council Member Gallup moved to approve Resolution No. 11 -11 as presented. Council Member <br />121 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br />122 <br />123 6B) Second Reading and Passage of Ordinance Number 03 -11, Amending the zoning ordinance <br />124 requirements regarding Motor Vehicle Sales Lots — City Planner Smyser reported that staff is <br />135 recommending this change to the city's zoning ordinance that would clarify the definition of a outdoor <br />126 sales lot. The term would be replaced by "motor vehicle sales lot" since that more clearly identifies its <br />127 intent in the code and clarifies that it is not a temporary use. Parking requirements are also being <br />128 clarified. <br />129 <br />130 Council Member Roeser moved to dispense with Full reading of the ordinance. Council Member <br />131 Gallup seconded the motion. Motion carried on a unanimous voice vote. <br />132 <br />133 Council Member Gallup moved to approve second reading and passage of Ordinance No. 03 -1 1 as <br />13-1 presented.
